John: the seller and the buyer are free to make a contract in which liability for non delivery rests with the buyer. But, and I may be mistaken about this, absent such a contract, the UCC would put the onus on the seller to deliver. I will look up the law on this [it's been a long long time since I studied or prascticed commercial law] but if some other lurking lawyer knows it, his/her contribution would be helpful.
I certainly agree that insurance for any high end item should be paid for by the buyer if the seller doesn't provide it but that doesn't mean the buyer is legally liable for non-delivery.
