Now if I'm looking at a particular variant of chip in an auction I ALWAYS email the seller & ask if the chip in the scan is the one I'll receive. You can take the risk of not asking but you will be dissapointed more often than you should be. On that note let me point put an ebay seller that springs to mind, aspeeg1801 who is Adam Speegle. He has 100's of different auctions running all the time & he ALWAYS scans the actual chip for sale. Great seller!!
I tend to agree with other members here. You live & learn & get on with it. Trust me, it's not just random ebay sellers that do this, it's members as well. You have to remember that mistakes do happen as well. This may have been completely unintentional. If not chalk it up to experience & add it to the "right off" pile
Regarding posting the sellers name - I believe freedom of speech may be written somewhere in your constitution but beware the savage backlash if it just so happens to be a friend or associate of someone readng it.
Good luck with a quick resolution whatever happens.
