1) Josh offered Rick insurance against loss/damage. The majority of this small group will agree that was the right thing to do.
2) Rick turned down Josh's offer of insurance. I think this small group of people would agree that wasn't the right thing to do in order to be protected against loss/damage.
3) Even though Rick decided to turn down the insurance offer, Josh proposed to work with Rick to repurchase his order at a reasonable discounted cost.
You can cite every rule of the UCC, Int'l Law or eBay Auctions (or whatever), this "small group of people..." have no rules, whatsover, regarding this issue when there is nothing spelled out in an agreement between a buyer who refuses insurance from a seller who is offering insurance should the buyer's item be lost/damaged in shipping.
When this "small group of people who should get along and do what's right" have a rule pertaining to such... then that rule should be expected to be followed.
Anything else stated within threads pertaining to this issue is nothng more than opinion... and opinion holds no water.
