... buyer who did not receive their goods (or received damaged goods) on a package that wasn't insured... yet alone refused to have the seller purchase insurance for the buyer... has no recourse, whatsoever, especially if there is no agreement in writing between the buyer and seller regarding loss/damaged item(s). The same [w/o insurance] holds true with the seller who does not purchase postal insurance... No recourse, whatsover; with anyone... Period.
Yes, I know the majority of us will make good if we were confronted with a similar situatioin being the seller, but the fact that the buyer in this case flat out refused insurance lessens the seller's responsibility, greatly...
I, too, would like to see Rick and Josh come to an agreement... and I commend Josh for attempting to clear a path for this...
Bottom line: Any seller who offers insurance on an item should make it very clear in an item description as to what is to be expected should the item not arrive when the buyer refuse such insurance.
