I disagree
The fact of the matter is that "we the people" are the government. These laws would not be passed if the majority of the people (ie "customers") were not saying enought is enought. We should not be subject to someone sitting beside us and fouling up the air we are breathing! The ratio is getting bigger and bigger as to non-smokers vs smokers. What it boils down to even if a hundred years from now they prove second hand smoke won't kill anyone it still makes a non-smoker uncomfortable. What a smoker is saying when he talks about "rights" is that he don't give a $hit what you think or how bad it stinks and if the dealers don't like it they can go work somewhere else!
