As your question does really clear up the confusion, the right thing is for you to get both.

If this were my auction, and I were the seller, I would email you both and offer you each one @ $104. I would also let you both know that I don't like doing it and I really believe they should both go to you, in the hope that status would let it go. There is NO WAY he gets one at $54.
eBay's read of this would stand, so there would be no feedback issues if he went nuts.
