I have been involved in three major accidents (none being my fault) and each time wanted compensation only for my actual costs. And each time, the insurance company refused to pay for something. In one instance, the ER looked us over to make sure that we weren't gonna die & then called an ambulance to take us to a second ER (the first ER was in Watts and had their hands full) -- the insurance company refused to pay the first ER bill & the second ambulance ride. After months of trying to get the insurance company to pay and getting nowhere, I consulted an attorney who settled about ten days later for my original amount plus $9K.
The next accident (same carrier), after seeking only to be made "whole" for costs, the first time I heard "No, we won't pay for that", I immediately consulted the same attorney and ended up with a similar result.
My advice...save yourself the time & headaches...consult an attorney. Mike, you worked in the refinery business just as I did for many years. These insurance companies seem to be run the same way as the refineries -- they can't spend the money to fix it right, but they CAN spend the money to fix it TWICE!!
