Are you suggesting a judgment can be entered against the club because a court found they lacked subject matter jurisdiction? I have never seen it. Has anyone else? A dismissal, if there was one, based upon lack of subject matter jurisdiction is different than a claim of frivolous litigation where the claims had no colorable basis. Subject matter issues do not go to the merits of the case.
