Fraud (civil, not criminal) can include statements made that omit material facts that would effect the buyer's decision to purchase. Do you think you would conisder it to be significant if the buyer was aware there were enough chips to put it in the R-5 category, for example? That could be enough in some jurisdictions. That's my understanding from years ago.
