One of my biggest complaints about this situation is the behavior of the banks. You would think that if you are a member (as am I in the credit union) they would look out for your interests. Not saying they should refund my money from the bad check, but I would think they would take the initiative to do some checking with the other bank in question. At least tell me that they are sure there is no error on either of the banks part. All I'm getting is "We're so sorry about the bad check, but we cannot do anything for you". They certainly were quick to take an additional $12 out of my account for the returned check!
The bank where the check originated from is even more passive about the unauthorized use of the check. When I questioned them about the unauthorized use of someone's account, and shouldn't they notify that account holder, their reply was that once they knew something was going on, they would take appropriate actions with their customer. They sent the check back to my bank...and they don't know that something is going on!!
However, I have been extremely impressed with both the responding officer and the detective in this situation. Both have really been eager to help me and have talked with me at length about what would be happening on their end.
