A Question of Ethics

Scenario:

Mr. Black (no not Archie), has a company with an identifiable name. Mr. Black is a long time collector, but has never branched his name toward any sort of WEB or internet presence. And nor does it seem he wants to, given the fact that his name has been around for quite a few years, and no point of establishment has been made.

Mr. White, has done research on the name of the company, as he likes it also. The name has never been registered as a domain, nor does it have any type of Internet presence (no links, refferences or email) so Mr. White registers it.

Opinions? Don't forget the Domain wars of the mid 90s when folks were buying up Top level Company Domains, and they stuck! The companies in question had dragged their feet and lost out. They then had to buy the domain back, but in some instances the domain was just traded back.

So, who's in the right here? I can tell you that according to Those Folks That Be, who register domains, Mr. White is the true owner of the name, at least on the Internet.
