That sounds like a definition to me. A correct statement would be, "To commit fraud, you must mispresent a material fact." Fraud is what the Black's Law Dictionary says it is, and that includes a number of things, including intent to defraud and damages, among other things. Once again, your definition was incomplete. I only commented on it so that readers, if there are any at this point, would have a greater understanding of the concept and how it might relate to all of the fact scenarios being discussed in the original thread. It's not a big deal, accept it and move on.
