There is criminal and civil fraud. In the civil case, it would be up to a jury of peers, unless a jury trial is not requested or the case ends in summary judgment or judgment on the pleadings. There are also legal rules which should guide a judge or jury. Party is open for potential liability and criminal charges, if certain missing information points to culpability.
