I am interested in why it is that you two can not resolve the matter.
Remarkably you only answered one of my questions. One thing I have learned is that when people avoid answering a question it is because they do not like the answer.
So just taking a wild guess here, your first email contact with Kirk was probably nasty. I'll never understand why people insist on doing this. If you start with name calling why do you think this will help you reach a resolution to the problem.
It probaly to late for this problem, but in the future you should give some thought to problem solving vs blame throwing.
Which would you respond more favorably to:
an email that said
1) "I just recieved the chip today, and I was disappointed as it was more worn than I anticipated. I would like to return it for a refund."
or an email that said
2) "You are a no good lying thief. You better give me back my money and I am not paying for shipping this crap back to you its not even worth $8"
