'Jurisdiction' is a major problem. There was some sort of test case. Not sure it was Sothebys or not. I believe it was determined that the auction was not only governed by state law as the auction was also 'broadcast' live and interactive in other cities and indeed continents.
Im also aware of another case where a Malaysian bidder failed to pay up for a NY auction and there was squat diddly they could do about it.
