to redeem chips

Horseshoe must give a local gambler cash for

his $5,000 tokens.

Bob Stupak's latest gamble appears to have paid off.

A Nevada Gaming Control agent ruled Tuesday that

Binion's Horseshoe is obligated to redeem $250,000 in

$5,000 chips that Stupak has.

On Monday evening, Stupak invaded the Horseshoe

-- which he says banned him Oct. 24 -- and again was

refused when he tried to cash a single $5,000 chip while

Nevada gaming officials watched.

The board made no decision, however, on the

estimated hundreds of others who also have $5,000 chips.

An Illinois pastor is seeking to obtain a class action

lawsuit against the casino on their behalf.

Horseshoe officials have 20 days to decide if they

want to appeal the decision for Stupak to cash his chips.

Attorney John Bailey, who works for the firm that

represents the Horseshoe, said the company has made no

decision.

"I'm pleased with the decision. I always expected that

(Gaming Control Board Chairman) Steve DuCharme

would carry on the tradition of the Nevada gaming board,"

Stupak said after being told of the decision by the

Review-Journal late Tuesday. He said he will make an

official statement today.
