I've seen such an analogy applied to this subject before, and find it to be just a little lame. While I don't believe there are any copyright infringement issues, I'd be more inclined to compare it to taking a Ford Mustang, stripping it down to the frame and drive train, putting a Camaro body on it, and still calling it a Mustang. It isn't restoring an original item, it is changing it. The paint reference would only hold true in my mind if that was indeed what was being done.
