I am not a lawyer, but I do know a little about business law. Unless otherwise specified, it is the seller's responsibility to deliver the items to the buyer. That means if the items are lost or damaged in shipment, it is the seller's responsibility to make good to the buyer. The seller may ask the buyer to pay for shipping and/or insurance. If the seller does not ask up front, than it cannot be the buyer's responsibility. Your trading partner is wrong. Legally you can take action against them. Practically it is not worth the effort in your case. I would submit a claim with the Club's Claim Director, as long as both of you are Club members. Otherwise, go ahead and take whatever actions you think are necessary to make yourself whole in this transaction.
