Casinos can protect themselves just as persons (human or corporate) who sell liquor can do so--by not knowingly selling their product to gambling addicts. While I will not attempt to predict the outcome of the Indiana suit I will not be surprised if there is a reversal given the fact that Aztar had notice of the plaintiff's habit/addiction and still lured him back.
But I am concerned about the direction these suits can go--the Falwell type moralists that would eliminate any activity in this country with which they disagree are going to push and push these suits--and what their brand of morality cannot do lawerying skills just might accomplish.
