David,
Do the casinos profit off the chips issued during the Club convention? Yes. And the Club gets what it is looking for. More exposure. The difference in this case IS the fact it is NOT a Club sponsored show. AND Liability is the MAIN CONCERN! This discussion went off in many different areas at some point.
Let's see if we can put some facts out and get back to the original concerns here.
Fact-No one has questioned whether Jim puts on a great show. All reports are he does. Fact-No one has wished failure on Jim's show. Jim does a lot to support the Club. I hope Jim makes a lot of money off this show. Fact-The original question was had he received Board permission for use of the logo. Fact-The first artwork scan Allan posted was a great looking chip, though there was no question it gave the impression of a Club sponsored event. Fact-the Board asked Allan to change the wording and he did. Fact-The Board approved the use of the chip with the logo and new wording. Fact-This is system we chose to govern our organization and the people we elected to make those decisions. Fact-Just becasue the Board has approved the use of the chip at Jim's show doesn't mean this should be the end to the discussion of the liability issue and logo use for future shows.
THE issue is protecting the Club from LIABILITY! Our convention contract has a clause that all dealers must sign that they "shall indemnify and hold harmless CC & GTCC, Inc., it's officers, agents and all volunteers." Does Jim's (or any other private promoter)table contract have such a clause? Has Jim (or any other private promoter) furnished a general liability policy to the hotel naming it and CC & GTCC, Inc. as loss payees? Thus protecting the Club's assets IN THE EVENT of an accident and potential lawsuit.
As much as a lot of us (myself included) would still like to think of this as a small, happy go lucky, all I want to do is collect chips Club, the fact is, it has become a business. The organization is governed by a Board, we are incorporated, we are non-profit, educational organization as recognized by the IRS,we file tax returns and we have hundres of thousands of dollars in assets. The days of the Club account being run out of a shoebox are long gone!
Ask anyone you know who owns a business or runs a company, if they take every possible step to protect the business from potential liability! I can assure you they do and if not, they are asking for trouble! Why do people carry liability insurance on their cars or even in their home owners policy? To protect themselves against loss! Should we not do the same thing? This has been the entire point of the discussion on this matter!
