How 'bout the casino itself?

In reading the threads here and in the past, one would get the impression that because they scanned an image that they have full rights to it. So, if someone wanted to use it they would have to ask permission. What if it were the casino it self? Or to reverse the situation what if the casino told YOU not to use it? Who's right? I have seen both examples on this board. Remember "Bad River"?
