I don't know, I would check into that with an attorney. A few things strike me.

First, how long ago did this magazine use the scans. If it wasn't too long ago you might still have some ability to hold them responsible. If it was too long ago your inaction might be percieved as concent. Especially since you appearently knew of the use and didn't respond.

Second, I can't believe that they can legally take your images off of your auction unless eBay has something in the agreements that you accept allowing them to license the book publisher to use material from auctions on their site. This raises the issue that you should probably put a copyright notice on photos and discriptions that you write for your ads. Maybe a notice, Photos, Illustrations and Discriptions of the lot in this auction are Copyrighted materials, and ©2002 Your Name.

Either way, I can not believe that the ability for the book company to use your image would make it illegal for you to use your own image again.

As I said, if you haven't already, and this is important enough to you, I would see an attorney. As I posted in my previous message, I would think your images will be older than theirs and if they want to get into a pi##ing fight you have more evidance that you own the scan than they do. Therefore, who actually owns the image and how did you transfer your rights to them???
