I suspect that Randy will not be able to bring a claim against this guy for "stealing" his scanned image. I say this because Randy does not have clear title (relaese) to have posted the same image to his web-site. Within the legal system there is a Latin phrase that says don't come to court with dirty hands. Although I do not disagree with what Randy has done (scanned and posted the chip) in the eyes of the court he has dirty hands.

I am not an attorney, however if an image on the WWW is not marked as copyrighted, or the site (on each page) does not include a prohibition, then "borrowing" a scan is not illegal. HOWEVER!!!!!! Whenever I use a someone elses scan(s) I ask first, and get their tacit approval!

THe fact that the eBay seller is using a scan of a likeness of the item he is selling and is not stipulating that fact is deplorable, and likely contrary to eBay rules. For such instances (by Club members mind you) I previously submitted to the "Glossary" these two acronyms:

SORI - Scan of Real Item

SOLI - Scan of Like Item

The SORI acronym is still there, but the SOLI has some how dropped out. I believe that we should use these expressions to make it clear to fellow Clib members.

Lastly, if you don't want your scans being used, then make them less ideal. Superimpose your "www" over a portion of the image.
