the Chip Guide frequently. The process is not discretionary unless the user claims "fair use", which has never happened. It would be burdensome and pointless for the Board to be involved with these decisions. It cannot be up for discussion for enforcement to be effective (you cannot protect your intellectual property, whatever it might be, if you selectively protect it). It is solely a matter of protecting the Chip Guide, so I see no reason why the MOGH cannot handle these issues on its own. The only reason people are worked up about this one is because the know the person who had their video taken down. By the way, the DMCA can be withdrawn at any time if proper credit is given.
Avoiding DMCA's is incredibly simple. If you use Chip Guide images, give credit to the Chip Guide for use of their images. If someone knows about this and knows the potential consequences (and in this case already agreed to give credit in his videos) and does not give the requested credit, or even respond to requests, they may have a DMCA filed. Blaming the CCA, Jim Follis (why?) or even Charles Kaplan is silly. There is a procedure, created by an attorney (not me) which is followed uniformly in order to avoid the possibility of having someone force the Chip Guide to shut down.
