For those who seem to be missing the point here, I'll quote directly from the conversation I had with a lawyer about this:
Me: "The images in the auctions are considered public domain; therefore, I don't need to ask for permission to use the pictures."
Lawyer: "Yes, no permission required."
Me" "So there is no expectation of privacy if the pictures are on ? What if they claim ownership of the photos in the auction and specifically say you can't use the photos 'Without the written consent of Major League Baseball'?"
Lawyer: "They have no copyright rights in the public domain unless they have specifically and expressly claimed them. If they ask you to stop, then stop. But as for 'stealing images', they have no legal basis for their claim. Tell them to go pound sand."
