Fraud requires intent.
If the Seller doesn't no the truth, the buyer is not a victim of fraud, he is a victim of a mistake.
Of course that doesn't mean the Seller shouldn't make it right when it is discovered.
Once the Seller is informed of the mistake, if he continues to make the representation he is now commiting fraud.
