From what I understand, they have sued hundreds of victims by name in two separate states (some media sources say they filed in multiple states, but I have seen direct mention only of California and Nevada). Grieving families must now obtain lawyers (at their own expense) and defend the action or take the chance that the court will enter a default declaratory judgment holding that MGM has no liability. That's a rotten move.
This is highly unusual - maybe unprecedented. There are many suits that have already been filed against Mandalay Bay, and the issues raised in the new lawsuits can be asserted as defenses in those suits. Requiring families to hire new attorneys (contingent fee attorneys don't generally work for free in added lawsuits) and appear in new lawsuits is reprehensible. And MGM had the balls to issue a press release saying it was better for the victims to be sued this way.
