"He who made the scan or photo owns the copyright unless he formally gives it up or transfers it to someone else. "
Show me in law where that is physically possible before 75 years after the death of the originator has passed.
You can't transfer copyright of a scan or photo. You can sell, licence or give unrestricted rights to it but the originator will always own the copyright UNLESS they were employed by someone to create it.
