If that is the case then of course I have to agree with Ricky. But it is standard in business that a non compete agreement is normally only good for a limited time (usually 1 year) it is seldom evoked for more than a year. Some states (Calif and Virginia) ban or limit such agreements. But in most all cases the agreement is subject to a time period. We don't know is there was such an agreement between the two of them and what if any time period was present.
