I'm not criticizing your post or what you said. So please do not read into my posts anything negative.
I too am am not defending any one side. All I'm trying to do is compare this situation to the COE and trying to see how it might apply to those of use who are club members...
If I understand your position, you are saying that since no money has changed hands, there is no contract. As a result, the seller could rescind the transaction with no harm done.
I'm not an attorney but I didn't think money had to physically change hands in order for a contract or agreement (either written or oral) to set in stone. I've never heard that money had to exchange hands... We're not talking about a "quote". We're talking about two meeting of the minds where they make an agreement sell "X" for given "$". If I agree to do that, then I believe according to our COE I must:
"fulfill all contracts and agreements which I make, either oral or written; to make prompt payment upon delivery..."
