Again, its not argument its discussion and it seems CG is trying to protect its images but doesn't want to abide by its own "rules", which are NOT binding because there is no where the user explicitly agrees.
Its a simple fix, make an agree and submit box. Because it's "inconvenient" to have the box is an irresponsible answer when asking for adherence to a rule you haven't agreed to with the user.
If I'm going to demand a cite of the chip guide when using images on the site I would certainly make sure I was on firm legal ground before demanding anything, otherwise I guess it should be a polite request to do the cite, not a demand stating they're "protecting ChipGuides intellectual property". In reality the images on CG, Ebay, Pokerchipper are the property of the submitter not the website unless specifically agreed to.
I too am trying to protect CG by offering sound advice that I have received from PokerChipper legal team. We have an Image Policy that you specifically agree to when registering and until you check off that you agree to the terms, that agreement is filed with the webMaster, you can't access the site. Now if you agreed to the terms, and you violate them, your access is revoked and you could be subject to legal action.
This is all common sense stuff and I'm not sure why there is this constant reluctance to follow the legal method of hosting a web site and have an explicitly agreed to user terms of service. While I know its inconvenient to the WebMaster unless you have this agreement between user and provider you HAVE NO STANDING TO DEMAND ANYTHING, just the ability to ask nicely, asking nicely speaks to the reputation of the site and its owners and admins. Its probably a stroke of luck that no on has brought suit against any of the sites for taking images without permission from ebay, heritage, or any other site.
Our Image terms look like this, the admin of chip guide can certainly come up with something similar, or maby has it posted but without EXPRESS AGREEMENT there is no enforcement option.
