ChipGuide Copyrights

This post is meant to start a dialog about how should the ChipGuide handle copyright violations.

Occasionally, I am informed that an eBay auction is using images from the ChipGuide, which is not allowed. First, I have to research the auction to confirm that the image has been taken from the ChipGuide. The ChipGuide does not allow use of its images for commercial purposes. When this occurs, the assumption is that the eBay seller is not aware of the policy and the following message is sent:

"Hello. I noticed that the images used in your eBay auction are from the ChipGuide. The ChipGuide does not permit the use of its images for commercial purposes. Please see the ChipGuide Usage Policy for more information, http://chipguide.themogh.org/cg_usage_policy.php

I assume that you are not aware of the policy and that you will comply within 24 hours of this notice. Failure to do so will result in the filing of a DMCA (Digital Millennium Copyright Act) violation filing with eBay. Thank you for your understanding and cooperation."

The message was formulated by the CCA's attorney. FYI, the DMCA makes website providers legally responsible if they do not remove copyrighted material when notified. The DMCA does not mean that you are being sued. It is just a notification to the website provider, eBay in this situation, that an eBay seller is using copyrighted material. About 95% of the time the eBay seller is understanding and removes the images. In over 10 years, only 2 DMCA violations have ever been filed with eBay. Some violators feel that the notice is too strong. But it is written to show that we are serious about protecting our assets. The 24 hour deadline provides plenty of time to remove the images and is reasonable considering how long the auctions may last. Handling these situations is my least favorite, but a very necessary, ChipGuide activity, thankfully it doesn't happen very often.
