If you’re referring to the dots on the inlay and clay not aligning, I’ve seen this on other chips before. Infrequent and rare but it does happen.
As for the spots being “painted on”, I’m assuming you have proof beyond just looking at the photos? If not then the claim lacks proof. If it’s “some of the spots have black showing through”, that black could also actually be on top of the spot color whether from gunk or more likely color transfer which is very common especially with a darker base color and lighter spot color.
Furthermore and maybe most damning, if they are painted on that means the person either found an all black chip with a Park Place $100 house mold already imprinted (never seen or heard of one existing and highly doubt it as it’d be a huge and unnecessary security risk for just what you’re claiming) OR and maybe even more unlikely if possible, you think someone made the chip (clay mix and mold) from scratch.
Is there a possibility it’s a fake? I guess but is it remotely likely and are the photos enough proof on their own to claim it’s a fake? No.
