How are they supposed to know?
In the past, other presidents have actually used, owned, or commissioned poker chips, and those chips have sold for big money. Since these fakes are made to look official this could lead to confusion of correct provenance in the future.
I do not know the legalities but can you even use trumps image? or the official seal? without permission or compensation?
