If you try to do a "Save as" for a file that's been saved under that name and the file is still open in Photoshop, you will get that error message. Either close the file in Photoshop or save under a different file name. There is no problem with doing a "Save as" the first time the file is saved, only when you try to "Save as" to the same name.
