I've bought a few pricy chips that became common when more came out, but I've experienced the reverse too, on occasion.
I don't know the history on the Binion's $5000 you point to, but the seller isn't representing that it is rare, and he started the auction at 99 cents.
So no misrepresentation on his part, unless he's done so on another occasion.
