I'm going to try and track down the decision, but this surprises me for an internet gambling case. The general argument is that poker is a game of skill because of bluffing, etc. (winning is not dependent solely on the probability of the cards). That element is largely removed with electronic versions since you can't look a player in his sunglasses to guess whether he's bluffing.
