A bacarrat game is dealt from a shoe and that shoe holds 6 decks (I think).
Discards are placed into a bucket and then put into a shuffler. Rather than wait for the shuffler to take time away from the game, some shufflers can handle multiple "shoes" of six decks. That way a shoe (six decks) is always available to use.
And, if a house wants to not waste time for the first hand to begin (when opening a table) they can order new cards (in a pack of six decks) and specify that they be pre-shuffled at the factory. That way the decks can move straigt from the box to the shoe and a game can begin.
However, when the factory creates decks of cards, they are normally arranged in suit order and then ace to 2 or king to ace, or in some sequential pattern. And if the casino wants them pre-shuffled, they then shuffle them.
But if the casino ordered them as pre-shuffled and the maker failed to do so, then chances are the six decks would be shipped in the seqential order, and if put directly into the shoe, then the players (who in this game are allowed to take notes as to which cards have been played) will quickly see the pattern and that the pattern repeats!!!
The casino appears to be claiming the "malfunctions" void all plays and all pays rule that is typical of slot machines.
