has not committed to buy, I would give that person first shot at the purchase depending upon what that person's "reservations" are/were before committing to buy (may want a better scan or to see the other side). I would put a time limit on how long that person has to respond or it gets sold to the next interested person.

And unfortunately, you're right...the seller is always wrong in these instances.
