Re: NCR Lawyers Smelling Blood in the Waters?

The theatrical part was ....

Imagine, though, that permanent damage was done to the engine.
Imagine that if the right engine had been properly repaired, the flight could have continued with only one engine and would not have had to "land" in the Hudson River.

There is No evidence ANY damage was done (permanent or otherwise). ".... IF had been properly repaired" Suggesting to the jurors that it WAS NOT when there was no evidence there was even ANY damage at all in the first place? In doing so you must 'imagine' many other things not being done as well. Pilot not reporting it, mechanics not checking or repairing it, no problems showing up in the cockpit that there was a problem with this 'permanently damaged' engine (over heat, over speed, vibrations, pressures, etc.) the following day. Air carriers seldom own the engines (they lease them) and close watch is made on the operating parameters engines are subjected to (it is recorded inside the plane). Often 'fines' are imposed on an airline for exceeding parameters by the manufacturer (leasor) because they have a huge liability in the operation of their engines. (They lease rather than sell to maintain some control on repair, service, and time in operation). There's a lot more to it than "Imagine Once upon a time" bedtime story the lawyer wants to lull the jury to sleep with. The lawyers know it the jury doesn't. LOL vbg vbg vbg vbg

So now lets 'IMAGINE' a jury award of 10 Million to each passenger who will be scared for life and never be able to work again due to the trauma and any future ailments, injuries, or disabilities that may be remotely connected to this incident. BUT.....The lawyer and the client are "IMAGINING" vacations in Hawaii, Margaritas in Cabo, and a Mansion in Vail Colorado.

The question is IF what you say is true was there evidence that there was negligence or intent. Prove that and you will sway me over to your side..... BUT within limits -NO 10 Million dollar settlements-
