First of all; at any given time eBay has several MILLION auction lots listed and there is no way they can police them all. Even chasing down violations that people bring to eBay's attention is a daunting, if not impossible task. All they can do is establish a set of ground rules and hope people follow them. If someone breaks the rules, they can say they are making an effort.

Second and most important of all; what I have discovered over the years is eBay doesn't care about anything other than the $$$. They're in it to make money, give a return to their investors, etc...

Finally, if a user is doing something that might get eBay sued, you can be sure they will step in and take what ever action they deem nessecary. IMHO, eBay is the only game in town that allows a seller to have access to a world wide market so they're kind of like the proverbial 900 pound gorilla. So as someone else said; build yourself some good eBay searches so they exclude all the junk you don't want to see.
