In a situation of driving related offence probation, and most other driving related cases I think jail time is absurd.

Our penal system is over taxed as it is, and I think the punishment is far worse then the crime. Now don;t get me wrong....I don;t condone her behavior in any way. I am speaking this way for everyone!

Let me tell an interesting story about me when I was young. When I was young, married only one year, and my wife 8 months pregnant I had received a 3rd moving violation within a one year period. Unlike the other two (fail to completely stop at stop sign, and one red light violation) this one was for speeding. In Ohio, when three moving violation occur with a 1 year period there is a mandatory court appearance.

To make a long story short, I appeared in court (not my county) and pleaded no contest (cop had me on radar). The judge states that I have a long history of reckless operation of a motor vehicles, and think that five days in the county jail would serve as a deterrent for future recklessness. He then asked if I had anything to say. BOY DID I!!!

To shorten he story some more, after explaining that I was never reckless, and that I had a pregnant wife who could deliver at any time, a job that required my presence, and elderly mother who relied on me, yada, yada, he agreed to let me off with a one year probation.

Now can you imagine going to jail in this situation?? Sure, it was a hillbilly area and a dumb a$$ judge but still!

Jails should be for criminals. The justice system should be done in a way where there are steps. Punishments should fit the crime. Pprobabtion first, then do house arrest. Then, and only then should jail be even a consideration.
