Bill is exactly right. Insurance companies hate it when they are threatened with going to the insurance commissioner. When I was working claims, Allstate was the one company that sends out denial letters to everyone, no matter what, just to see if they can deter people from filing claims, including to their own clients.
File a claim with the insurance commission, and if that doesn't work, seek counsel. You are due resitution for the damages, car rental, and bodily injuries.
