If it happened to me I would be ticked. The person shouldn't have done it. I would spoke up as you did, and would have been more than upset if the person had taken on an attitude with me.

I had a similar situation occur. Ultimately it worked out, however in retrospect I wish I had handled it less confrontationally, it only escalated the situation, and caused bad feelings with a person who turned out to be a alright guy.

For the record, when he received your money, and cashed your check, he was legally bound to provide the item. But if you were childish enough to take this to court, you would lose because he returned your money. It would be almost impossible to prove any damages, and such a small matter would possibly sned a judge over the edge.

So I suggest you accept the reality, and remember it next time.
