OJ was charged with Murder, he stood trial and was found not guilty of murder. That is a criminal finding, and the presumption applies to a criminal matter. The proof necessary here is "beyond a reasonable doubt".
Being legally responsible is not the sme as Murduer (remember I told you earlier that they were different).
For example a Doctor who handles a surgery sloppily could be found to be legally responsible for the death of the patient, but it lacks the elemental requirements to be murder.
Preponderance of evidence is two levels of evidentiary proof behind beyond a reasonable doubt.
Ultimately the civil dertermination was not that he was guilty of anything, simply responsible.
