That has happened to me on several occasions. It's the seller's responsibility to accurately represent the item. I sell hundreds of chips a month and I always take pictures of the actual chip being sold regardless of how many duplicates I have or the extra time it takes. If he doesn't respond I wouldn't hesitate to bring the matter up with Ebay. I've had to do this once and they responded to my concerns pretty quickly.
