1. A deception deliberately practiced in order to secure unfair or unlawful gain.
If a seller has 20 of a chip (or who knows how many) and is advertising it as an R-9 then he is telling everyone via his advertising that there is only 4-7 of these known to exist when in reality he knows that is not true. Or, if he is advertising a chip as an R-10 rating he is advertising that only 2-3 are known to exist. Since he's personally sold more of the $25 orange arodies and the $25 diswirls on ebay than either prior rating than why would he advertise either as an R-9 or R-10 if he knows that not to be true? As I said in my prior post everyone is entitled to draw their own conclusions as to his intentions.
And, all of the above is based on only 20 existing. What happens in reality if 300 exist? Unfortunately, we have no idea how many of these chips are in his possesion since he won't tell anyone. I don’t think a lot of collectors would be too happy to spend $500 or more on a chip only to find out in a few months they’re being sold for $19.95 as refrigerator magnets via the home shopping channel.
