Such a suit would have to be brough by men. Woman would have no standing to bring such a suit.
Even then, the men would fail if there are other job descriptions at this employer that they could fill.
The Borgata is well within its rights to set forth very restrictive job descriptions and/or requirements. What the suit will alledge is that the application of this is either arbitrary or malicous with respect to certain employees.
Like I said, I doubt the suit has much merit but attorneys are concerned with things like that. They will try and extort money from the company under the threat of a litigation hazard. It is why attorneys are so well respected these days.
