You mentioned that Cali got sued over asking a muslim to take off her burka for her drivers license photo. I don't know the outcome of that suit - but a suit itself is not the problem - you can sue me because you don't like the way I spell my name. It's not the suit, it the fact that these suits "win" - who's making these decisions - is it juries (then it's our own fault), is it judges - then there's a problem. Do juries have as many executive types as minimum wage types - I don't know but I could see themore "professional" professions getting out of jury duty more than minimum wage workers. And, I could see a jury of minimum wage earners being much more interested in giving someone millions of dollars than I would see a jury filled with higher earning professionals.
Now to my main point - and I'm sure it'll piss some people off : ) I think the problem is that we've got so many lawyers in America compared to other developed countries that they are all looking for work - which can mean making up suits, retrials, etc. It seems similar to stockbrokers that encourage you to continually trade.
The lawyers have stolen America's justice system and replaced it with a legal system. OJ Simpson prefers this new system.
