If a chip is purchased at the casino gift shop, would that chip be considered a fantasy chip or a souvenir chip?

The reason I am asking is that The Chip Rack lists the Hard Rock Barris set as never being used for gaming, instead it was sold in the gift shop. Also, when I see this set for sale, it is never mentioned in the description as never being meant for gaming. With all the talk on this board about false descriptions on ebay, would failure to mention Fantasy or Souvenir be considered a false statement in this case?
